As the Obama Administration allows more legal marijuana states to go on without the federal government interfering, there are no laws that would stop the next president to shut down the marijuana industry as soon as he enters into office. Although the fact remains that most 2016 presidential candidates have not made plans to stop the marijuana market when they win the elections. This gives us hope that there has been enough evidence presented to make an extreme strike against marijuana.

Earlier this week, Diana DeGette, a Democratic Representative from Colorado said that she would like to bring the “Respect States’ and Citizens Rights Act” back. This is a measure that would not allow the president to ban the selling of legal marijuana. The bill failed to win years ago, but because of the widespread change in perspective of the drug, many suspect that it would pass this year. This would also provide a : shield against federal law.”

DeGette told reporters in a press conference that the best reason for the legislation to be reconsidered is because of the upcoming presidential election. There is uncertainty over who will win therefore all precautions must be taken. The industry is already being halted because of conflicting state and federal laws. DeGette argued that procrastinating efforts until after elections may, in fact, ruin all of the efforts that have been put forth thus far.

“The threat of adverse federal action remains,” DeGette stated. “Especially if a future president to this one approaches marijuana issues differently.”

Dana Rohrabacher, a Representative from California, also introduced a similar bill in the House of Representatives this year. His proposal was called the “Respect State Marijuana Laws Act of 2015” and sought to give individuals and marijuana businesses “immunity from federal prosecution.” Similar to DeGette’s proposal, the bill also aims to amend the Controlled Substances Act so that marijuana businesses cannot be taken down by the Federal Government so long as they are within legal boundaries.
