For medical marijuana there are many obstacles, however this past week it saw the passage of a critical cannabis legislation from both houses of Congress that should permit medical cannabis patients and marijuana-based businesses to breathe a bit more comfortably once again in 2016.
Back on June 11, the Senate Appropriations Committee gave a green light to a provision developed to protect medical marijuana businesses from federal interference, involving the DEA, in places where medical marijuana is currently legal.
Currently, 23 states have a legal medical marijuana program for licensed patients while four states have legalized it for recreational use. As documented by the Huffington Post, the Senate committee passed the measure as an amendment to the Commerce, Justice and Science appropriations bill for fiscal 2016.
The vote carried out by the Senate Appropriations Committee followed a vote from the House of Representatives back in the beginning of June, which was introduced and passed successfully with a vote of 242 to 186.
If this legislation does get the go-ahead to be signed into law which will be no walk in the park with President Obama and the Republican-led Congress continuously complaining over spending bills it potentially could ensure the same defense afforded to legal cannabis operations that was signed into law in 2015. If in fact this legislation does not successfully pass, a gray area could emerge amongst the pull of the DEA and individual stat laws that possibly could hinder licensed cannabis businesses and cause licensed individuals eligible for medical marijuana problems in gaining access to the drug.
