The state of Florida’s noneuphoric medical cannabis law overcame a major legal obstacle this past Wednesday when a judge in Tallahassee upheld it, which allows the state to start licensing cannabis growers this summer. Florida’s Administrative Hearings Judge David Watkins refused the claims by an Orange County nursery that the state’s suggested rules and regulations were unfairly created to provide an advantage to bigger, politically connected nurseries to become victorious with the 5 regional medical cannabis growing licenses the law allows.
As a result, the Florida Department of Health can file the rules as “final” and start requesting applications for the licenses within three weeks, given that Baywood Nurseries of Apopka doesn’t appeal Watkins conclusion.
Attorneys for Baywood didn’t instantly return calls for comment this past Wednesday. Supporters of the limited medical cannabis law were thrilled. “It’s about time we all moved forward on this,” stated Seth Hyman, a medical-marijuana advocate. “It’s been too long, and the patients of Florida continue to suffer, which includes my little 9-year-old-daughter, Rebecca.”
The state of Florida can now start developing a statewide medical marijuana program that so far has only been proposed.
